1. Introduction
The present General Conditions of Sale (hereinafter General Conditions ) govern the sale of products (hereinafter the Seller) using only the technology of distance communication (Internet, telephone, fax). All contracts entered into to purchase products through the site www.newgardenstore.eu following the procedures described above (online or by phone), between the Seller and the buyers (the Customers) will be governed by these General terms and Conditions, which form an integral and substantial part of same.

2. Mode of conclusion of the contract
The information contained on the site www.newgardenstore.eu should not be considered offers: they are simply an invitation to offer.
The purchase (order) is made by You when sending the form containing the characteristics of the goods, the price, mode of payment and terms of delivery (the order form).

3. Prices and terms of payment

4. Mode of payment
The Customer undertakes to pay the price of the products ordered using the payment methods specified on www.newgardenstore.eu

5. Transport and Delivery
The Products are delivered in accordance with the procedures specified in the site www.newgardenstore.eu as determined by the Customer at the time of submission of the order. The transport costs are borne by the Customer.
The terms of delivery indicated in the transport conditions of the site www.newgardenstore.eu they are not binding nor in Italy nor abroad. They simply indicate the period of time that is assumed to be normally required to deliver the goods from the time of the courier delivery charge.

6. The right of ownership and transfer of risk of deterioration of the asset
The right of ownership of the Products passes to the Customer after full payment of the products or their delivery, if this is last. The risk of rupture and/or deterioration of the Products passes to the Customer at the time of delivery of the goods to the carrier.

7. Right of withdrawal
purchases made on our website are subject to the discipline of D. Lgs n. 185 of the 22-05-1999, dictated in respect of distance contracts, in the case in which the delivery of the goods takes place at the domicile of the purchaser, as such purchases are perfected outside the business premises. The customer may then exercise the right of withdrawal by returning the goods and obtaining the reimbursement of any such material.
What to do to exercise the right of withdrawal:
- To obtain the refund, the customer must notify us within 14 days from the date of receipt of the goods to want to exercise the right of withdrawal, to the email address silvia@newgardensas.it , must also be indicated the reasons for willingness to return, the list of materials to be returned, the mode of refund (paypal, postepay or bank transfer).
- Upon agreement, the client must return, at their own expense within 14 days of the material in the original condition, through a courier service or a parcel traceable (parcels sent cash on delivery, carriage paid or carriage forward will not be accepted).

-The refund will be paid only for the goods (shipping costs not included), and according to the methods agreed within 5 days from the date of receipt of the returned package.

8. Acceptance, warranty and refunds
The products will be deemed accepted by Customer at the time of their delivery. Except in the case where the Client exercises the right of withdrawal referred to in art. 8 above, such acceptance is presumed until the Customer informs the Seller, in the shortest possible time. The goods always travel at the total risk of the recipient. Any damage due to transport must be reported to the carrier and will be charged to the New Garden sas (except in the case of insured shipping).The signaling of the goods are faulty or do not comply with the order paid must be made by phone at no. 0425 727520 or via mail at the address info@newgardensas.it possibly enclosing photos of the articles on the subject. Following such communication, the Seller will contact promptly the customer and will provide, as available, to replace defective products or refund the amount paid by the Customer for their purchase. In cases where the application of safeguards providing for the return of the product, the product must be returned by Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment, consumables intact, manuals, cables, etc..) to limit damage to the original package, we recommend, when possible, to enter into a second box; should be avoided in all cases affixing labels or adhesive tapes directly on the original packaging of the product.

The Seller has the right to test the Products at the time of their return and to charge the Customer for any cost incurred by the Seller in the event of a false declaration of inoperability or defective products. The return of products purchased through special offers or promotions, or as part of a package of products may be subject to specific conditions, as described in the same or otherwise communicated to the Customer. No refund is allowed for individual products purchased inoperative as part of a package, but Seller may, alternatively:
1) replace that single product,
2) to demand the return of the entire package of products and refund the amount paid by Customer for the purchase of the same package.
the Seller reserves The right to seek reimbursement of any promotional discount on Products other than those purchased by the Customer defective when such discounts have been granted on the purchase of the Product, that was returned and the price of which was reimbursed by the Seller.
No damage can be requested from the Seller for any delays in repairs or replacements.

9. Obligations of the Customer
The Customer undertakes, once the purchase procedure provided by the site www.newgardenstore.eu to provide print and keep these general conditions, and information contained on the site www.newgardenstore.eu dedicated to information on how to purchase, pursuant to and by effect of articles. 3 and 4 of D. The present general conditions are governed by Italian law and are reported, although not expressly provided herein, to the D. Lgs. no. 50/92 to D. Lgs. no. 185/99.

Important Note: this revision of The General Conditions, namely that at the time of signing by the Customer of the order, regulate the order; the Customer is therefore requested to print and keep a copy of these Terms for future reference.
